1Acceptance of Terms

Welcome to AloLabs+ ("we," "us," "our," or "the Company"). These Terms of Service ("Terms") govern your access to and use of our mobile application and services (collectively, the "Service").

⚠️ Important Legal Agreement:

By downloading, installing, accessing, or using the AloLabs+ app and services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Service.

1.1 Who These Terms Apply To

  • All Users: Patients, visitors, and anyone accessing our Service
  • Geographic Scope: Services provided within the Republic of Iraq, primarily Kurdistan Region
  • Platform: Mobile app (iOS and Android) and related web services

📱 About AloLabs+: We are a healthcare technology platform connecting patients with laboratory testing services in Kurdistan Region, Iraq. We employ certified blood collection technicians (authorized by Hanasa Medical Lab) and partner with certified medical laboratories for testing and digital test result delivery.

2.1 Our Business Model

🤝 Technology Platform + Laboratory Partners:

  • AloLabs+ provides: Mobile app, booking system, certified blood collection technicians (authorized by Hanasa Medical Lab), payment processing, customer support, digital result delivery
  • Laboratory Partners provide: Laboratory testing, test result generation, quality control
  • Technician Authorization: All AloLabs+ blood collection technicians are authorized and supervised by Hanasa Medical Lab
  • Important: Blood sample collection at your home is ALWAYS performed by AloLabs+ certified technicians. Laboratory testing is performed at the certified medical laboratory you choose for your tests

2.2 Service Area

  • Primary Service Area: Duhok, Kurdistan Region, Iraq
  • Expansion: We may expand to other areas in Kurdistan and Iraq
  • Availability: Subject to technician availability and geographic coverage

2.3 How It Works

  1. Create an account and complete your profile
  2. Select the laboratory tests you need (browse or upload prescription)
  3. Choose the laboratory where you want your tests performed
  4. Choose your service address (home, office, etc.)
  5. Book appointment for sample collection
  6. AloLabs+ certified technician (authorized by Hanasa Medical Lab) visits to collect samples
  7. Samples are transported to your chosen laboratory for testing
  8. Test results are generated by the laboratory and delivered through our app
  9. View, download, and manage your test results

🇮🇶 Iraq-Specific Service: Our Service operates exclusively within Iraq and is subject to Iraqi and Kurdistan Regional Government laws and regulations.

3User Registration and Account

3.1 Account Creation

To use our Service, you must create an account by providing:

  • Required Information: Full name, phone number, date of birth, gender, address
  • Optional Information: Email address, profile picture
  • Sign-In Methods: Email/phone, Google Sign-In, Apple Sign-In

3.2 Eligibility Requirements

⚠️ Age Requirement:

  • You must be at least 18 years old to create an account
  • Parents or legal guardians may create accounts for minors
  • You must have legal capacity to enter into binding agreements

3.3 Account Responsibilities

You are responsible for:

  • Confidentiality: Keeping your password and account credentials secure
  • Accuracy: Providing accurate, current, and complete information
  • Updates: Keeping your profile information up to date
  • Activity: All activities that occur under your account
  • Unauthorized Access: Notifying us immediately if you suspect unauthorized use

3.4 Account Security

  • Use a strong, unique password
  • Do not share your login credentials
  • Log out after using shared devices
  • Enable device security features (biometric, PIN)

3.5 Family Accounts

You may add family members to your account:

  • You can book services for family members
  • You are responsible for all family member information
  • Family member health data is protected under the same security standards
  • Only the primary account holder can access family member data

👶 Minors: When booking for children under 18, the parent/guardian must be present during sample collection and is responsible for all medical decisions.

4Medical Services and Disclaimers

🚨 CRITICAL MEDICAL DISCLAIMER:

AloLabs+ is NOT a healthcare provider. We do NOT provide medical advice, diagnosis, or treatment.

4.1 What We Are NOT

  • ❌ We are NOT a medical practice or healthcare provider
  • ❌ We do NOT provide medical consultations or advice
  • ❌ We do NOT diagnose medical conditions
  • ❌ We do NOT prescribe treatments or medications
  • ❌ We do NOT provide emergency medical services
  • ❌ We do NOT replace visits to your doctor

4.2 What We ARE

  • ✓ A technology platform connecting you with laboratory services
  • ✓ A booking and coordination service
  • ✓ A digital delivery system for lab test results

4.3 Laboratory Services

🔬 Laboratory Partners & Blood Collection:

  • Blood Sample Collection: Performed by AloLabs+ certified technicians at your home
  • Technician Authorization: All our technicians are authorized, trained, and supervised by Hanasa Medical Lab
  • Laboratory Testing: Conducted at the certified medical laboratory you choose for your tests
  • Laboratory Licensing: All partner laboratories are licensed by Kurdistan Regional Government health authorities
  • Test Results: Generated by the chosen laboratory and delivered through our app
  • Quality Assurance: Partner laboratories maintain quality control and comply with health regulations

⚠️ Important Note:

While you may choose different laboratories for testing, ALL blood collection technicians are employed by AloLabs+ and authorized by Hanasa Medical Lab, ensuring consistent quality standards for sample collection regardless of which laboratory you choose for testing.

4.4 Test Results Disclaimer

⚠️ LABORATORY RESULT RESPONSIBILITY:

AloLabs+ is NOT responsible for the accuracy, quality, completeness, or interpretation of any laboratory test results.

The chosen laboratory (Hanasa Medical Lab or other certified laboratories) is FULLY and SOLELY responsible for:

  • All laboratory testing procedures and analysis
  • Accuracy and quality of test results
  • Result interpretation and reporting
  • Any errors, mistakes, or inaccuracies in test results
  • Quality control and laboratory standards

AloLabs+ ONLY facilitates:

  • Blood sample collection through our certified technicians
  • Transportation of samples to the chosen laboratory
  • Digital delivery of results through our app

We do NOT validate, verify, or quality-check laboratory results in any way.

  • Test results are provided for informational purposes only
  • Results must be interpreted by a qualified healthcare provider
  • Laboratory errors may occur despite quality controls - this is the laboratory's responsibility
  • Results timing depends on specific tests and lab processing
  • If you have concerns about result accuracy, contact the laboratory directly

4.5 Medical Emergencies

🚨 FOR MEDICAL EMERGENCIES:

DO NOT use our app. Call emergency services immediately at 122 or visit the nearest hospital.

Our Service is NOT suitable for urgent or emergency medical situations. Do not rely on our Service for time-sensitive medical needs.

4.6 Your Responsibilities

  • Consult with a qualified healthcare provider about your test results
  • Follow your doctor's medical advice and treatment plans
  • Seek immediate medical attention for emergencies
  • Inform your doctor of all medications and health conditions before testing
  • Follow pre-test instructions (fasting, medication restrictions, etc.)

5Booking and Service Terms

5.1 Booking Process

  1. Select Tests: Choose from available tests or upload a prescription
  2. Choose Laboratory: Select your preferred certified medical laboratory for testing
  3. Choose Location: Provide or select your service address for blood collection
  4. Schedule Appointment: Select date and time for sample collection
  5. Review Details: Confirm booking information, chosen laboratory, and pricing
  6. Receive Confirmation: Get booking ID and appointment details

5.2 Sample Collection Requirements

  • Presence: You (or family member) must be present at the scheduled time
  • Location: Provide a safe, clean environment for sample collection
  • Identification: Valid ID may be required for verification
  • Pre-Test Preparation: Follow any fasting or preparation instructions
  • Access: Ensure our technician can access your location
  • Cooperation: Allow our certified technician to perform the blood collection procedure

5.3 Cancellation Policy

⚠️ IMPORTANT CANCELLATION RULES:

Please read carefully to avoid cancellation fees and account suspension.

5.3.1 Before Appointment Confirmation

✅ FREE CANCELLATION: You can cancel your appointment at any time BEFORE we confirm the booking. No charges apply.

  • Cancel through the app directly
  • No cancellation fees
  • No penalties or restrictions

5.3.2 After Appointment Confirmation

⚠️ LIMITED CANCELLATION OPTIONS:

Once your appointment is confirmed, you CANNOT cancel through the app.

To cancel a confirmed appointment, you MUST:

  • Call our Help Center: +964 750 843 4930
  • Email: support@alolabsplus.com
  • Request cancellation BEFORE the technician is dispatched

Help Center will review your cancellation request and may approve it based on:

  • Timing of the request
  • Reason for cancellation
  • Whether technician has been dispatched

5.3.3 Technician Dispatched - Cancellation Fees Apply

🚨 MANDATORY CANCELLATION FEES:

If the technician has been dispatched to your location and you cancel or are not present:

  • ❌ You will be charged cancellation fees
  • ❌ Cancellation fees must be paid immediately
  • ❌ If you refuse to pay cancellation fees, your account will be SUSPENDED
  • ❌ Suspended accounts cannot book new appointments until fees are paid

Cancellation fees cover:

  • Technician transportation costs
  • Time spent traveling to your location
  • Opportunity cost of rejected appointments

5.3.4 No-Show Policy

🚨 NO-SHOW = FULL CHARGES + POSSIBLE SUSPENSION:

If you are not present when the technician arrives:

  • You will be charged cancellation fees
  • Repeated no-shows may result in account suspension
  • Account will remain suspended until fees are paid

5.3.5 Account Suspension

⚠️ Your account will be SUSPENDED if:

  • You refuse to pay cancellation fees after technician dispatch
  • You are a no-show and don't pay the required fees
  • Multiple cancellations after confirmation (even if fees paid)

During suspension:

  • ❌ Cannot book new appointments
  • ❌ Cannot access booking features
  • ✅ Can still view past test results

To reactivate account:

  • Pay all outstanding cancellation fees
  • Contact Help Center for account review
  • Account will be reactivated within 24 hours of payment

5.3.6 Emergency Situations

🏥 Medical Emergency or Urgent Situations:

If you have a genuine medical emergency or urgent situation preventing you from being present:

  • Call Help Center immediately: +964 750 843 4930
  • Explain your situation
  • Provide documentation if possible (hospital admission, etc.)
  • We may waive cancellation fees on a case-by-case basis

Note: Emergency waivers are at our discretion and not guaranteed.

5.4 Rescheduling

5.4.1 Before Confirmation

  • ✅ Free rescheduling through the app
  • Unlimited changes before confirmation

5.4.2 After Confirmation

⚠️ Must Contact Help Center:

  • Cannot reschedule through app after confirmation
  • Call Help Center: +964 750 843 4930
  • Subject to technician availability
  • Must reschedule BEFORE technician dispatch
  • Multiple rescheduling may result in booking cancellation

5.5 Service Completion

  • Service is complete when blood sample is collected
  • Technician may refuse collection if conditions are unsafe
  • You may refuse service, but charges may apply
  • Payment is due upon sample collection (cash on delivery)

5.6 Test Results Delivery

  • Results delivered through the app when ready
  • Push notification sent when results are available
  • Typical turnaround: 24-48 hours (varies by test type)
  • Delays may occur due to laboratory processing or technical issues

6Pricing and Payment

6.1 Pricing

  • Currency: All prices displayed in Iraqi Dinars (IQD)
  • Inclusive: Prices include home collection service fee
  • Test Pricing: Displayed in app for each test
  • Package Pricing: Discounted rates for test packages
  • Emergency Service: Additional fees may apply for urgent requests
  • Prescription Tests: Final price determined after technician review

6.2 Payment Methods

  • Cash on Delivery: Primary payment method (pay technician after sample collection)
  • Digital Payment: May be available for some services (through secure payment processors)
  • Vouchers/Promo Codes: Can be applied at checkout

6.3 Vouchers and Promotional Codes

  • Expiration: Valid for limited time only
  • Usage Limits: Typically one per user or booking
  • Combination: Generally cannot be combined with other offers
  • Terms: Each voucher has specific terms and conditions
  • Fraud: Fraudulent voucher use will void the discount and may result in account suspension

6.4 Refund Policy

  • Before Collection: Full refund if cancelled per cancellation policy
  • After Collection: No refunds unless service was not provided as agreed
  • Incorrect Results: Lab may retest at no charge if error is confirmed
  • Technical Issues: Refunds evaluated case-by-case
  • Processing Time: Refunds processed within 7-14 business days

6.5 Price Changes

  • Prices may change without prior notice
  • Confirmed bookings are charged at the booking time price
  • Price changes do not affect existing bookings

💳 Payment Security: We do NOT store credit card information. All card payments are processed by PCI-compliant payment processors.

7User Content and Conduct

7.1 Prescription Uploads

When uploading prescriptions or medical documents, you represent that:

  • The prescription is valid and legally issued by a licensed healthcare provider
  • You have the right to use the prescription
  • The prescription is for the person named in the booking
  • Information provided is accurate and complete

7.2 Ratings and Reviews

  • You may rate technicians and services after completion
  • Reviews must be honest and based on actual experience
  • Reviews must not contain offensive, defamatory, or inappropriate content
  • We reserve the right to remove reviews that violate these Terms

7.3 Prohibited Conduct

⚠️ You Agree NOT To:

  • ❌ Use the Service for illegal purposes
  • ❌ Provide false or misleading information
  • ❌ Impersonate others or falsify identity
  • ❌ Interfere with the Service's operation or security
  • ❌ Attempt unauthorized access to systems or data
  • ❌ Harass, abuse, or threaten our staff or technicians
  • ❌ Use the Service to spread malware or viruses
  • ❌ Reverse engineer or copy our software
  • ❌ Scrape or extract data from the Service
  • ❌ Use the Service in any way that violates Iraqi law
  • ❌ Attempt to game or manipulate vouchers and promotions
  • ❌ Create multiple accounts to abuse offers

7.4 Technician Interactions

  • Treat technicians with respect and professionalism
  • Provide a safe working environment
  • Do not offer bribes or inappropriate inducements
  • Report any inappropriate technician behavior immediately

7.5 Consequences of Violations

Violations may result in:

  • Warning or suspension of your account
  • Permanent termination of your account
  • Forfeiture of prepaid amounts
  • Legal action if violations are criminal in nature

8Privacy and Data Protection

8.1 Privacy Policy

Our collection, use, and protection of your personal and health information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

8.2 Key Privacy Points

  • Personal Information: We collect name, contact info, address, date of birth
  • Health Information: Lab test orders, results, medical history
  • Location Data: GPS location for service delivery and navigation
  • Device Information: Device type, OS, app version, crash reports

8.3 Data Sharing

  • Chosen Laboratory: Share data necessary for laboratory testing and result generation with the laboratory you select
  • Our Technicians: AloLabs+ certified technicians (authorized by Hanasa Medical Lab) for blood collection at your home
  • Hanasa Medical Lab: For technician authorization, oversight, and quality control purposes
  • Technology Providers: Firebase, Google Maps, payment processors
  • Government: Only when required by Iraqi law or valid court order

8.4 Data Security

  • All data encrypted in transit (HTTPS/TLS)
  • Health data encrypted at rest (AES-256)
  • Access controls and authentication
  • Regular security audits

8.5 Your Rights

  • Access your data
  • Correct inaccurate information
  • Request account deletion (medical records retained per Iraqi law)
  • Export your test results
  • Control location tracking and notifications

🔐 Medical Confidentiality: Your health information is protected under Iraqi medical confidentiality laws. AloLabs+ staff, our blood collection technicians, Hanasa Medical Lab (for technician authorization), and all partner laboratories are bound by these laws and professional medical ethics.

9Intellectual Property Rights

9.1 Our Intellectual Property

All content and materials on the Service are owned by AloLabs+ or licensed to us, including:

  • AloLabs+ name, logo, and trademarks
  • Mobile app software and code
  • Website design and user interface
  • Text, graphics, images, and videos
  • Database structure and organization

9.2 Limited License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Download and use the mobile app on your personal device
  • Access and use the Service for personal, non-commercial purposes
  • View and download your own test results

9.3 Restrictions

You may NOT:

  • Copy, modify, or create derivative works of our software
  • Reverse engineer, decompile, or disassemble the app
  • Remove copyright or trademark notices
  • Use our trademarks without written permission
  • Sell, rent, lease, or sublicense the Service
  • Use the Service for commercial purposes

9.4 Your Content

You retain ownership of content you upload (prescriptions, photos, etc.), but you grant us a license to:

  • Store and process your content to provide the Service
  • Share with our authorized technicians and your chosen laboratory for service delivery
  • Share with Hanasa Medical Lab for technician authorization and quality oversight purposes
  • Use anonymized data for service improvement

9.5 Copyright Infringement

If you believe content on our Service infringes your copyright, contact us at legal@alolabsplus.com with details.

10Disclaimers and Limitations of Liability

10.1 Service Availability

⚠️ "AS IS" and "AS AVAILABLE" Service:

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

We do NOT guarantee:

  • Uninterrupted or error-free service
  • Accuracy, reliability, or completeness of information
  • Specific results from using the Service
  • Technician availability at all times
  • Specific timeframes for test results

10.2 Medical Disclaimer

🚨 CRITICAL: NO MEDICAL OR LABORATORY RESULT LIABILITY

AloLabs+ accepts ZERO responsibility for:

  • ❌ Medical diagnosis, treatment, or advice
  • ❌ Accuracy, quality, or interpretation of ANY laboratory test results
  • ❌ Laboratory testing errors, mistakes, or inaccuracies of any kind
  • ❌ Laboratory testing delays or processing time
  • ❌ Medical decisions made based on test results
  • ❌ Health outcomes related to testing or lack of testing
  • ❌ Any consequences arising from incorrect or delayed laboratory results
  • ❌ Missed diagnoses or misdiagnoses resulting from lab result errors

⚠️ Clear Responsibility Division:

  • AloLabs+ is responsible for: Blood sample collection by our technicians, sample transportation, digital result delivery
  • Laboratory (Hanasa Medical Lab or chosen lab) is responsible for: ALL testing procedures, result accuracy, quality control, result interpretation

Any issues with test result accuracy or quality must be directed to the laboratory that performed the testing, NOT AloLabs+.

10.3 Third-Party Services - Laboratory Liability

⚠️ LABORATORY PARTNER LIABILITY:

The chosen laboratory (Hanasa Medical Lab or other certified laboratories) is FULLY and INDEPENDENTLY responsible for:

  • All laboratory testing procedures and protocols
  • Test result accuracy, completeness, and quality
  • Laboratory equipment calibration and maintenance
  • Quality control and quality assurance procedures
  • Staff training and competency
  • Compliance with laboratory standards and regulations
  • Any errors, omissions, or negligence in testing

AloLabs+ is NOT liable for any actions, errors, omissions, or negligence by the laboratory.

Other Third-Party Services:

  • We maintain quality control over our blood collection technicians (this is our responsibility)
  • We are not liable for third-party technology services (Firebase, Google Maps, etc.)
  • Payment processor errors are subject to their terms
  • Cloud storage services operate under their own terms and security protocols

10.4 Limitation of Liability

To the maximum extent permitted by Iraqi law:

  • We are NOT liable for indirect, incidental, special, or consequential damages
  • Our total liability is limited to the amount you paid for the specific service
  • We are not liable for damages beyond our reasonable control

10.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including:

  • Natural disasters (earthquakes, floods, etc.)
  • War, terrorism, or civil unrest
  • Pandemic or public health emergencies
  • Government actions or regulations
  • Power outages or telecommunications failures
  • Internet service disruptions

⚖️ Iraqi Law: These limitations are subject to Iraqi law. Nothing in these Terms limits liability that cannot be limited under applicable Iraqi law.

11Indemnification

You agree to indemnify, defend, and hold harmless AloLabs+, our laboratory partners, Hanasa Medical Lab (for technician authorization), and our respective officers, directors, employees, agents, and partners from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your Use: Your use or misuse of the Service
  • Violation of Terms: Your violation of these Terms
  • Violation of Rights: Your violation of any third-party rights (including intellectual property, privacy, or publicity rights)
  • False Information: Providing false, inaccurate, or misleading information
  • Illegal Activities: Any illegal or unauthorized use of the Service
  • User Content: Content you upload or submit through the Service

🛡️ What This Means: If your actions cause us legal problems or financial losses, you agree to cover those costs. This protects us from liability for your misuse of the Service.

12Governing Law and Dispute Resolution

12.1 Governing Law

🇮🇶 Iraqi Law Applies:

These Terms are governed by and construed in accordance with the laws of the Republic of Iraq and the Kurdistan Regional Government, without regard to conflict of law principles.

12.2 Jurisdiction

  • Legal disputes are subject to the courts of the Kurdistan Region (Duhok or Erbil)
  • You consent to the personal jurisdiction of these courts

12.3 Dispute Resolution Process

Before filing any legal action, we encourage the following process:

  1. Contact Customer Support: Attempt to resolve the issue through our customer support at support@alolabsplus.com
  2. Good Faith Negotiations: Both parties agree to negotiate in good faith for 30 days
  3. Arbitration (Optional): If negotiation fails, disputes may be submitted to arbitration in Kurdistan Region, Iraq
  4. Legal Action: If all else fails, legal action may be filed in Kurdistan courts

12.4 Costs

  • Each party bears its own legal costs unless otherwise ordered by a court
  • Prevailing party may be entitled to attorney fees under Iraqi law

13Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted.

13.1 How We Notify You

  • In-App Notification: Alert when you open the app after changes
  • Email Notification: For significant changes
  • Service Announcement: Banner or notice in the app
  • Updated Date: "Last Updated" date at the top of this page

13.2 Material Changes

For significant changes that affect your rights or obligations:

  • We will provide prominent notice at least 30 days in advance
  • You may be required to accept the new Terms to continue using the Service
  • You have the option to discontinue use and delete your account if you disagree

13.3 Your Acceptance

⚠️ Continued Use = Acceptance:

By continuing to use the Service after changes take effect, you agree to be bound by the updated Terms. If you do not agree to the changes, you must stop using the Service.

13.4 Checking for Updates

We recommend reviewing these Terms periodically. Check the "Last Updated" date to see when changes were made.

14Termination

14.1 Termination by You

You may terminate your account at any time:

  • Through app settings ("Delete Account")
  • By contacting customer support at support@alolabsplus.com
  • Note: Medical records will be retained for 10 years as required by Iraqi law

14.2 Termination by Us

We may suspend or terminate your account immediately, with or without notice, for:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Abuse of staff, technicians, or other users
  • Multiple failed payment attempts
  • Extended period of inactivity (3+ years)
  • Any reason at our sole discretion to protect the Service or other users

14.3 Effect of Termination

Upon termination of your account:

  • Your access to the Service will be immediately disabled
  • Pending bookings may be cancelled (refunds subject to cancellation policy)
  • You remain liable for any outstanding payments or obligations
  • Most personal data will be deleted within 30 days (except as required by law)
  • Medical records retained for 10 years per Iraqi health law
  • Financial records retained for 7 years per Iraqi tax law

14.4 Survival

The following sections survive termination:

  • Payment obligations
  • Intellectual property rights
  • Disclaimers and limitations of liability
  • Indemnification
  • Governing law and dispute resolution

15Additional Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AloLabs+ regarding the Service and supersede all prior agreements.

15.2 Severability

  • For users in Iraq, the Arabic version prevails
  • For all other matters, the English version prevails
